In most recent versions (since we differentiated the Freeware and the Pro-Edition), both XXCOPY Freeware and Pro-Edition have their sign-on line (and the copyright notice) at the beginning of the program output: XXCOPY == Pro Edition == Ver 2.xx.x (c)1995-2001 Pixelab Since we decided to use the same program name for the different packages, you cannot tell them apart by the file name. But, once you run them, you can tell which one is which. As we indicate in the license terms in the XXCOPY home page and in the accompanying documentation as well as the display on the user screen shown by the running program, when you order a license for XXCOPY-Pro, you need to tell us the number of computers whose storage devices (disk) you intend to access using the XXCOPY program. Our license fee is based upon the number of computers --- not how many computers on which you execute the XXCOPY program. If you are working for a company which provides services and you carry a tool diskette with XXCOPY, you definitely need to bring a Pro Edition with you since you will be operating XXCOPY on a computer (and probably accessing other computers which are not your personal property). When your company acquires the XXCOPY license from us (Pixelab, Inc.), your company has to provide us with a best estimate of how many computers the company (including you as a consultant who are sent to the customer site) will use in the next 12 months. We base our license fee based on the declared number of computers. This may be not precise. But, making a very accurate count is either unworkable or not practical. At best, it will be a very unpopular thing (to pay a price for anything is not very popular in general) We figure if your company offers a service to another company for profit, the charge should include the small license fee that we ask your company to pay. If you are an individual who work as a consultant and perform your professional service to your client using XXCOPY as a tool, that is a commercial activity and you must use XXCOPY-PRO with a proper license ---- we assume that when you acquired your current XXCOPY-PRO license, you did make an estimate of the number of computers that you would use for the next 12 months. And, we assume your estimate was to the best of your knowledge at the time. Since your client has no XXCOPY license (unless you arrange a separate license for them), you should delete the XXCOPY program from the client's machines. If you install XXCOPY on a permanent basis on your client's computer as a backup script (and your client's computer usage is for business), then your client needs a proper XXCOPY-PRO license --- we have an arrangement for the case where you install XXCOPY to your client's machine. In that case, we sell license to your customer and you receive a commission as a dealer --- please send us Email for detail. If you are doing this for fun and you are helping your friend, you should use the Freeware version. You may give away the XXCOPY freeware package to your friend which is permitted as long as you give him the entire package as a whole. We prohibit the transfer of just one file (say, XXCOPY.EXE from the freeware). We want your friend to receive the full package including the documentation which describes the licensing terms for the freeware. ------------------------------------------------------------ XXCOPY (even its freeware version) is not a public domain piece and we intend to exercise our copyright to tell you what is permitted and what is not. People often make reference to other "typical" software products that are administered on their license terms and copyrights. That's their business. We have our terms and policy. Other company's policy never applies to us. Obviously, the copyright laws and legal precedents with regards to similar products have some influence on our implementation of licensing terms. But, let me emphasize the distinction: Other company's license terms never apply to XXCOPY, but the copyright laws and other legal precedents do apply to our products. ----------------------------------------------------------- Now, if you are a computer professional and have a diskette with XXCOPY-PRO for your commercial activities at your clients' computers, make sure you count all computers that are accessed by XXCOPY. Often times, you pay for XXCOPY license beforehand. This makes the counting process a "forecast" of how many computer you will use in the next 12 months. Your obligation to us here is that you must be as accurate as possible in predicting your future business. We will take your best estimate and use that as the basis of our license fee. Please note that our licensing terms are written in deliberately short paragraphs. We want you to read them and make the best interpretation of the language (without hiring a lawyer) you can. We fill in the unspoken rules which are derived from the spirit of our licensing terms. We rely on your best estimate and honest counting as the basis in determining the license fee. Our company is made of only engineers and no lawyers. If you work in an IT department, you know how much XXCOPY is worth for your company much better than your corporate lawyers. That is why our licensing terms are in plain English and short. We don't need lawyers!!!
